Our role
Big Bear Car Shipping ("we", "us") operates this website as a lead generation and referral service for auto transport. We are not a motor carrier and do not transport vehicles. Shipments are priced, booked and performed by independent, licensed and insured auto transport brokers and carriers ("providers") under their own terms. Your contract for transport is with the provider, not with us.
Quotes and estimates
Quotes and figures displayed on this site are estimates for general information, based on information you provide and current market conditions. They are not a binding offer. Final pricing, pickup windows, transit times, insurance coverage and availability are determined by the servicing provider and may vary from any estimate.
Your responsibilities
You agree to provide accurate information about yourself and your vehicle, including whether it is operable and any modifications that affect loading; to prepare the vehicle as instructed; to be available, or to designate an authorized adult, at pickup and delivery; and to inspect the vehicle and note any issues on the bill of lading before signing.
Communications
By submitting a request you consent to be contacted by us and by providers by phone, SMS and email regarding your request, as described in our Privacy Policy.
Limitation of liability
To the fullest extent permitted by law, we are not liable for any loss, damage, delay or claim arising from transport services performed by a provider, including damage to a vehicle, late pickup or delivery, or pricing changes by a provider. Claims for loss or damage in transit must be made against the provider's cargo insurance in accordance with the provider's terms and the bill of lading. Our total liability to you for any claim arising from use of this site shall not exceed the amount you paid to us, if any.
Intellectual property
The content, design and trademarks on this site belong to Big Bear Car Shipping or its licensors and may not be copied or used without permission.
Acceptable use
You agree not to submit false requests, interfere with the site's operation, scrape its content or use it for any unlawful purpose.
Indemnification
You agree to indemnify and hold harmless Big Bear Car Shipping and its officers, employees and agents from any claim, loss or expense, including reasonable attorneys' fees, arising from your breach of these terms, inaccurate information you provide, or your use of the site.
Disclaimer of warranties
The site and its content are provided "as is" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted or error-free or that estimates will match a provider's final price.
Dispute resolution
Any dispute arising from these terms or your use of the site shall first be raised with us in writing. If not resolved within 30 days, the dispute shall be resolved by binding individual arbitration administered by a recognized arbitration provider under its consumer rules, in Los Angeles County, California, except that either party may bring an individual claim in small claims court. You and we waive any right to a jury trial or to participate in a class action.
Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Subject to the arbitration provision above, the state and federal courts located in Los Angeles County, California have exclusive jurisdiction.
Severability and entire agreement
If any provision of these terms is held unenforceable, the remainder stays in effect. These terms, together with the Privacy Policy and Disclaimer, are the entire agreement between you and us regarding the site.
